List has been revised. Even in the revised call, none is present for the revisionist, whereas learned counsel for the opposite party No. 2 as well as learned A.G.A. for the State are present.
Perusal of order dated 01.07.2015 reveals that vide order dated 31.01.1994 notice had been issued to opposite party No. 2 and operation of impugned order dated 19.01.1994 had been stayed till further orders of this Court, thereafter, revisionist never turned up in this criminal revision, hence interim order passed by this Court got vacated and communicated to lower court concerned. Even after that, none appeared for the revisionist to press this revision.
This criminal revision was against judgment and order dated 19.01.1994 passed by Judge, Family Court, Kanpur Nagar in Case No. 358 of 1991 in a proceeding under Section 125 Cr.P.C.; Smt. Sadiqa Khatoon Vs. Mohd. Sadiq. A maintenance of Rs.300/- per month was awarded against husband-revisionist in favour of opposite party No. 2-wife. This has been assailed on the ground that revisionist was with no means to maintain opposite party No. 2; no specific finding with regard to income of revisionist was given and revisionist was ready to maintain opposite party No. 2, but she has deserted revisionist.
It appears that by lapse of time, this revision has become infructuous. Even on merit, the order is with all reasons.
Hence, this revision is dismissed.
