Court No. - 38
Case :- WRIT - A No. - 14780 of 2019 Petitioner :- Mahendra Yadav And 8 Others Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Vidhya Shanker Tiwari Counsel for Respondent :- C.S.C.
Hon'ble Ashwani Kumar Mishra,J.
Petitioners are claiming notional increment inasmuch as petitioner nos.1 & 2 for a period from 1.7.2015 to 30.6.2016, petitioner no.3 for a period from 1.7.2014 to 30.6.2015, petitioner no.4 for a period from 1.7.2013 to 30.6.2014, petitioner nos.5 & 6 for a period from 1.7.2009 to 30.6.2010 and petitioner nos.7 to 9 for a period from 1.7.2008 to 30.6.2009 and that their claim has not been considered in that regard.
The petition is opposed by learned Standing by submitting that petitioners' claim is highly belated.
Admittedly, all petitioners have retired from 2008 to 2016. No claim was raised for grant of such benefit within a reasonable period. The judgment of the Madras High Court is made the basis for petitioners' claim which was delivered on 15.09.2017. This judgment would not constitute any basis for the petitioners to seek revision of salary almost after expiry of sufficient period. A fresh representation is not required to be entertained for reopening of such issues, after long lapse of time. No direction, therefore, is required to be issued, as is prayed for, in this petition.
The writ petition is, accordingly, dismissed.
