Order on the Modification Application The modification application is filed seeking modification of the judgment and order dated 29.09.2021. It is argued that the directions given by this Court on 29.09.2021 be modified by giving directions to the respondents to grant duties to the petitioner as this Court has held that the dismissal of the petitioner was bad in law. It is also argued that the petitioner is due to retire within three years and undertakes that he would not claim back wages.
In view of the said , the order dated 29.09.2021 is modified to the extent that the respondents shall grant duties to the petitioner and order in that respect shall be passed within a period of three months from the date of filing a copy of this order before the respondent no.3 in accordance with law.
In view of the aforesaid following portion of the order dated 29.09.2021 is recalled:-
" It is directed that the respondents shall reconsider the case of the petitioner for grant of duties in accordance with law expeditiously, preferably within a period of three months from the date of filing of a copy of this order before the respondent no.3, in accordance with law without taking his age into consideration."
The modification application is accordingly disposed of.
