The sole appellant in this appeal Mahesh Upadhyay is reported to be dead. In this regard, the report was sent from C.J.M., Agra. The record shows that the report of C.J.M. dated 16.10.2017 has been received to this Court informs part of the record, according to which, the appellant has died on 11.2.2017 in S.N. Hospital, Agra. The other details of inquiry have been mentioned in the C.J.M's report. The death certificate was also issued regarding the death of appellant Mahesh Upadhyay. According to C.J.M.'s report, the statements of CW-1, CW-2 and CW-3 confirming the death of appellant is also part of the record and have been sent by C.J.M. to this Court.
In view of matter, this appeal must need its nemesis and should abate.
This appeal stands abated.
Office to do needful in compliance with the order. The bail bonds and sureties of the present appellant Mahesh Upadhyay also stands discharged.
