Heard learned counsel for the petitioner and learned A. G. A. for the State. This petition has been filed by the petitioner with the prayer to issue a writ, order or direction in the nature of mandamus commanding respondent no. 2 to transfer the investigation of the F.I.R., which has been registered as Case Crime No. 69 of 2016, under sections-452, 323, 392, 504, 506 and 427 IPC at P. S.-Kotwali, district-Bareilly from Bareilly zone to other zone.
After hearing learned counsel for the parties and perused the material brought on record, this writ petition is disposed of without expressing any opinion on merits, with liberty to the petitioner to file a representation raising all the grounds which have been taken by him in this writ petition with the prayer to transfer the investigation of the aforementioned case before the respondent no. 2. In case any such representation is filed before respondent no. 2 along with certified copy of this order within three weeks from today, the same shall be considered and decided by the respondent no. 2 strictly in accordance with law within a further period of three weeks.
