Article 226 of the Constitution of India for issuance of writ of mandamus directing the respondents to pay the salary to the petitioner from 08.11.2010, the date of appointment as per the 6th Pay Commission.
Since the issue involved in all these writ petitions are identical and the prayer sought for are also similar, they were heard together and are being disposed of by this common order.
2. The prayer in all these writ petitions is for issuance of a writ of mandamus to direct the respondents to pay salary to the petitioners, as per the 6th Pay Commission, from the date of their appointment.
3. It is pertinent to note that the petitioners have sought for the relief on par with the petitioners in W.P.(MD) No.12110 of 2009, wherein this Court, by order dated 01.07.2011, granted a positive direction directing the second respondent to pay the revised salary that was given to the Tamil Nadu Government Employees as well as arrears to the petitioners therein. But, the petitioners herein were not parties in the said W.P.(MD) No.12110 of 2009. Furthermore, in the present writ petitions, notice regarding admission alone has been ordered and they are ye to be admitted. In such circumstances, the petitioners herein are not entitled to the relief sought for on par with the petitioners in W.P.(MD) No.12110 of 2009.
4. In the result, all these writ petitions fail and they are dismissed. No costs.
