This Writ Petition has been filed by Madina High School, managed by Madina Education and Welfare Society, rep. By its Secretary, K.M.Arifuddin assailing the action of the respondents in not considering the representation dated 12.1.2009 for grant of No Objection Certificate to commence CBSC syllabus from Class I to V in the petitioner’s school.
The petitioner-school submitted an application on 12.1.2009 for grant of No Objection Certificate for establishing CBSC syllabus from Class I to V. The Deputy Inspector of Schools, Himayathnagar Zone having satisfied by the proposal submitted by the petitioner-school forwarded the application to the 2nd respondent-District Educational Officer, Hyderabad on 28-3-2009. Certain objections were pointed out and the same came to be complied with by the petitioner-school. There being no action on the application submitted by the petitioner- school, the writ petition has been filed invoking jurisdiction under Article 226 of the Constitution of India.
When the writ petition came up for admission the learned Assistant Government Pleader for School Education takes notice on behalf of the respondents.
Heard learned counsel appearing for the petitioner-school and learned Assistant Government Pleader for School Education.
The limited grievance of the petitioner-school is that the representation- dated 12.1.2009 has not been considered by the respondents. In that view of the matter, the writ petition is disposed of directing the respondents to consider the representation-dated 12.1.2009 and pass appropriate orders within two weeks from today.
