By order dated 7.3.2018 in Writ-A No.7334 of 2018, this Court permitted the applicant to make representation within two weeks alongwith certified copy of the order and in which event, respondent no.3 to the writ proceedings was to decide the same within two months. There was a further direction that in case the applicant is held entitled to any amount, the same would be paid within next one month.
Counsel for the applicant invited the attention of the Court towards an order passed by opposite party on 25.4.2018, whereby he has called for records from the Management/Principal of the institution to enable him to examine the claim of the applicant and thereby facilitate payment of amount found due and payable.
Counsel for the applicant submitted that after passing of the said order, no final order has been passed nor any payment has been made to the applicant.
At this stage, this Court is not inclined to proceed in contempt against the opposite party, as he has already undertaken proceedings for determining the claim of the applicant. However, in case the claim is not decided or payment is not made in terms of the direction issued by the Writ Court within next eight weeks, it shall be open to the applicant to approach this Court again by way of fresh petition.
The contempt application stands disposed of accordingly.
