Heard learned counsel for the applicant as well as learned A.G.A. for the State of U.P and perused the material available on record.
Learned counsel for the applicant has contended that the applicant has been shown to be involved in one case registered at Case Crime No.825 of 2019, under Sections 380, 457 I.P.C., Police Station Robertsganj, District Sonbhadra in the gang chart in which he is on bail. Copy of the bail order has been annexed as annexure no.2 to the affidavit filed in support of the bail application. The applicant is in jail since 25.07.2021 in the present case.
Learned A.G.A. has opposed prayer for bail.
Without expressing any opinion on merits of the case but considering the facts and circumstances of the case, nature of accusation and the severity of punishment in case of conviction and the nature of supporting evidence, reasonable apprehension of tampering with witness or apprehension of threat to the complainant and prima facie satisfaction of the Court in support of the charge, the applicant is entitled to be released on bail. Accordingly, bail application is allowed.
Let the applicant Madhuranjan Gaur involved in Case Crime No.03 of 2021, under Sections 3(1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police Station Robertsganj, District Sonbhadra, be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
