1. Heard Sri Mohit Kumar Singh, learned Counsel for petitioner and Sri Sanjay Singh for respondent 1 and 2.
2. Admittedly, Original Suit No.686 of 2018 is pending in the Court of Civil Judge (J.D.) Koal, Aligarh. In pursuant thereto, a letter dated 04.12.2018 has been issued by Bank informing petitioner to put settlement on hold till further instruction are received from Court.
3. Learned Counsel for petitioner submitted that there is no restrain order passed by the Court.
4. In our opinion, remedy lies before the Court below where suit is pending and this writ petition under Article 226 of the Constitution of India is not maintainable.
5. Dismissed on the ground of alternative remedy.
