Lathia, learned advocate for the appellant has filed sick-note. Matter is adjourned to 19.01.2012. In the meantime, learned advocate for the appellant shall take appropriate action in respect of unserved respondent No.1 failing which the appeal qua unserved respondent will stand dismissed.

It is made clear that on the next date of hearing If Mr. Lathia, learned advocate is not in a position to remain present, he shall make alternative arrangement failing which the appropriate order shall be passed.
