Applicant has moved the present anticipatory bail application seeking bail in Case Crime No.157 of 2019, under Sections 420, 323, 504, 506, IPC, Police Station Kundarki, District Moradabad.
I have perused the prosecution story as set up in the F.I.R. and also the anticipatory bail rejection order.
The contention of the counsel for the applicant that applicant has been falsely implicated in the present case; that the applicant is the husband of the first informant; that there is dispute between the husband and wife; that there are various litigations are pending between the husband and wife; that the present FIR has been lodged against the applicant only with the intention of building pressure upon the applicant for compromise the litigations pending between the parties; that the investigation is still pending as on date; that the matter needs deeper and fairer investigation before any arrest should be given effect to; that the applicants are willing to participate and cooperate with the investigation. Therefore, the applicant may be enlarged on anticipatory bail.
Learned AGA appearing for the State has opposed the prayer for anticipatory bail of the applicant, but could not dispute the aforesaid facts as argued by the counsel for the applicant.
Keeping in view the reasons as stated above, the facts and circumstances of the case as have been discussed at the Bar of this Court, without expressing any opinion on the merits of the case, considering the nature of accusation, the applicant is entitled to be released on anticipatory bail in this case.
