…Petitioner …Respondent This Writ Petition is filed under Articles 226 and 227 of Constitution of India, praying to set aside the auction notice dated 31.08.2019 issued by the respondent in Kannada Prabha News paper dated 01.09.2019 with respect to the petitioner’s property issued by the respondent as per Annexure-J and etc.
This Writ Petition coming on for Orders this day, the Court made the following:-
ORDER Petitioner has questioned the validity of Annexure-J and further sought for a direction to dispose of S.A. No.404/2019 vide Annexure-H on merits.
2. In respect of questioning Annexure-J, he has remedy before the Debts Recovery Tribunal. Other prayer for disposing of S.A. No.404/2019 is concerned, DRT-I, Bengaluru is directed to decide the same, at the earliest.
With the above observations, writ petition stands disposed of.
