Madras High Court|09 February, 2017

JUDGMENT / ORDER

[Order of the Court was made by T.MATHIVANAN, J.] Heard the learned counsel appearing on behalf of the petitioner, as well as the learned Additional Public Prosecutor appearing on behalf of the respondents 1 and 2.
2. The petitioner herein is the father of the detenue. In the petition, the petitioner has stated that the third respondent had kidnapped his daughter and in this connection, he had lodged a complaint with the second respondent police and on the face of the complaint, a case in Crime No.357 of 2016 was registered.
3. When the petition was taken up for hearing today, the learned counsel for the petitioner has produced a letter alleged to have been written by the detenue Meena, wherein she has stated that she had married the third respondent and has been living with him comfortably, but there is a strong objection on her parental side to get married with the third respondent. She has further stated that at the time of hearing of the earlier habeas corpus petition filed by her father in H.C.P.No.1085 of 2016, she had already appeared before this Court along with her husband.
4. We have perused the letter produced by the learned counsel for the petitioner and convinced that the detenue is safe and she is not in the illegal custody of the third respondent.
5. Keeping in view of this fact, we are of the view that since the detenue has attained majority, no further order is necessary in this petition. Accordingly, the Habeas Corpus Petition is closed.
