Respondent Criminal Original Petition filed under Section 482 of Code of Criminal Procedure to conduct and conclude the case No.25 of 2014 pending against the petitioner before the Chief Judicial Magistrate Court, Tiruppur within a specified period of time as may be fixed by this Court.

Mr.E.Raja, Additional Public Prosecutor O R D E R This Petition has been filed to conduct and conclude the case in Special C.C.No.25 of 2014 pending against the petitioner before the learned Chief Judicial Magistrate Court, Tiruppur within a specified period of time as fixed by this Court.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent and perused the materials available on record.
3. The learned counsel for the petitioner submitted that the petitioner is a senior citizen and he is suffering from ill health. The case is pending for more than two years without any progress. Hence, the petitioner has come forward with the present Criminal Original Petition seeking a direction to the trial Court to dispose of Special C.C.No.25 of 2014 within the specified time limit.
4. On the other hand, the learned Additional Public Prosecutor, who took notice on behalf of the respondent, has submitted that now the case is posted on 23.02.2017 for framing charges and the matter is regularly taken up by the trial Court.
5. Taking into consideration the reasons stated by the petitioner and the fact that now, the case is posted for framing charges, this Court directs the trial Court to dispose of Special C.C.No.25 of 2014 on merits, as expeditiously as possible, preferably within a period of one year from the date of framing charges.
6. With the above said direction, the Criminal Original Petition is disposed of.
