Prayer : Civil Miscellaneous Appeal filed under Order 43 Rule 1(u) of Civil Procedure Code, to set aside the reversing judgment and decree dated 26.12.2005 passed in A.S.No.24 of 2003 by the VI Additional Judge, City Civil
Court, Chennai and confirm the judgment and decree dated 08.04.2002 passed in O.S.No.37 of 1997 by the XIII Assistant Judge, City Civil Court, Chennai.
For Appellants : No appearance For R3 and R4 : Mr.P.T.Ramkumar, Standing Counsel for Railways J U D G M E N T When the matter was taken up on 01.11.2017, the learned counsel appearing for the appellants reported no instructions. Therefore, Registry was directed to print the name of the appellants and post the matter on 02.11.2017. On 02.11.2017, when the matter was taken up, again, there was no representation on the parties and the matter directed to be listed on 06.11.2017 under the caption “for dismissal”. Inspite of name was printed in the cause list, there was no representation on the side of the appellants. As last chance, Registry was directed to post this appeal on 07.11.2017. Even on 07.11.2017, there was no representation on the side of the parties and the matter was posted on 08.11.2017 under the caption “for dismissal”.
2. When the matter is taken up today (08.11.2017) once again, there is no representation for the appellants. Hence, this Civil Miscellaneous Appeal is dismissed for default. No costs. Consequently, connected miscellaneous petition is closed.
