For Petitioner : Mr.P.Pazhamalai For Respondent : Mr.C.Emalias, APP ORDER This Criminal Original Petition has been filed seeking a direction to the respondent police to file the final report in Crime No.355 of 2013 pending on his file.
2. The case of the petitioner is that as against one K.Socratis, Managing Director of M/s.Eften Engineering Pvt. Ltd., Chennai, he has lodged a complaint before the learned Metropolitan Magistrate No.II, Egmore, who, in turn, forwarded the same to G3 Kilpauk Police Station, Chennai for registration. Pursuant to the same, a case in Crime No.355/2013 was registered for the offences punishable under Sections 403, 406 and 420 IPC on 11.05.2013. Finding no progress in the case, the petitioner has filed a petition in Crl.O.P.No.30418 of 2015 before this Court seeking a direction to file a final report. By order dated 04.01.2016, the said petition was disposed of by directing the Inspector of Police, G3 Kilpauk Police Station, Chennai to complete the investigation and file a final report within a period of two months. Subsequently, in the month of February 2016, the case was transferred to the file of the respondent herein, since the amount involved is more than Rs.35,00,000/-. Even thereafter, final report was not filed. Hence, this petition.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor, who took notice for the respondent.
4. Considering the facts and circumstances of the case, this Court is of the view that the delay on the part of the respondent in filing the final report, cannot be countenanced. Therefore, the respondent police is directed to investigate the case in Crime No.355 of 2013 pending on his file and file a final report, if not filed earlier, as expeditiously as possible, preferably, within a period of eight weeks from the date of receipt of a copy of this order.
5. Accordingly, the Criminal Original Petition is ordered.
