Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the respondent to register a First Information Report under Sections 503, 506(2), 415, 420, 120 and 120-B of the Indian Penal Code for the complaint dated 13.11.2015 and to investigate into the offences and file a final report.
2. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that on the basis of the complaint dated 13.11.2015 given by the petitioner, an enquiry was conducted by the respondent police and the enquiry reveals that the matter is purely civil in nature and civil suit is also pending before the civil Court in O.S.No.6024 of 2015. Hence, the matter is to be closed as civil in nature and the closure report is also made ready.
3. At this stage, learned counsel appearing for the petitioner seeks liberty to lodge a fresh complaint before the respondent police with new facts.
4. Recording the said submission made by the learned Additional Public Prosecutor, the present criminal original petition is closed. It is always open to the petitioner to approach the respondent police as and when required.
