Heard Mr. Sunil Kumar Srivastava, learned counsel for the revisionists and the learned A.G.A. for the State.
This Criminal Revision has been filed challenging the order dated 18.07.2018 passed by the Additional Chief Judicial Magistrate, Devband, Saharanpur in Complaint Case No.376 of 2016 (Nathi Ram vs. Lokesh and others), under Section 363 I.P.C., P.S. Nanuta, District Saharanpur whereby the discharge application filed by the revisionists has been rejected.
The Court below has rejected the discharge application filed by the revisionists on the ground that firstly, the revisionists have not appeared personally before the Court and secondly, the statement of the prosecution witnesses under Section 244 Cr.P.C. is yet to be recorded. Both the findings recorded by the Court below appear to be perfectly justified. Consequently, there is no scope for interference in the present Criminal Revision.
The present Criminal Revision fails and is accordingly dismissed.
