This criminal revision has been filed has been filed seeking modification in the order dated 06.08.2019 by making the revisionist and mother of opposite party Nos. 2 and 3 equally responsible to maintain them passed by learned Family Court/Additional District Judge, Fast Track Court, Rampur in Criminal Misc. Case No. 109 of 2014 (Km. Jahanbi Singh and Another Vs. Lokesh Kumar), under Section 125 Cr.P.C. Police Station Civil Lines, District Rampur.
Heard learned counsel for the revisionist as well as learned A.G.A. and perused the record.
Counsel has not been able to point out any illegality, impropriety or incorrectness much less than any abuse of Court's process, which may persuade this Court to interfere in the impugned order. The impugned order reflected judicial application of mind. The record shows that the revisionist is the father of the children. Children are admittedly along with their mother. The revisionist was not only under legal obligation but also share responsibility to take care of his children. The facts and circumstances of the case have been duly analised and discussed by the court below while passing the impugned order. There is no element of perversity reflected in the matter. In the present days of high price rise, the amount of Rs.8000/- each to both children per month cannot be said to be either excessive or disproportionate. The fact that the mother is also employed and earning money, does not itself entitle father to shirk from his onus and liability to maintain his children. Revisionist is sufficient resources of income and a well earning person as he is an employee of Railway. There is no good reason to take a different view in the matter.
The revision lacks merit and stands dismissed.
