Heard Sri V.M. Zaidi, learned Senior Counsel assisted by Sri M.J. Akhtar, learned counsel for the petitioners and Sri Pranjal Mehrotra, learned counsel for the respondents-Nagar Nigam and perused the record.
Present petition has been filed challenging the order dated 1.4.2019 and the order dated 4.4.2019 passed by the Courts below.
Admittedly, a Misc. Appeal is already pending against the order dated 1.4.2019.
Sri Pranjal Mehrotra, learned counsel for the respondents-Nagar Nigam states that 29.4.2019 is fixed for consideration of the interim injunction application filed by the petitioner in appeal.
As such, I do not find any good ground to entertain the present petition as the appeal is already pending before the competent lower appellate Court.
Accordingly, present petition stands disposed of with liberty to the parties to pursue their case on the next date.
Both the parties agree that they shall cooperate in the hearing of the Misc. Appeal on the next date itself. Otherwise, the Court below shall fix short dates and no unnecessary adjournments shall be granted for disposal of the appeal as the apprehension expressed by the leaned counsel for the petitioners is that the respondents-Nagar Nigam is proceeding further for demolition of the property in question.
No order as to costs.
