Heard Shri P.S. Pandey, Advocate holding brief of Shri Rahul Kumar Tyagi, Advocate appearing for the petitioner and Shri Devesh Vikram, learned Standing Counsel for the State respondents.
The petitioner is stated to have made a complaint against the elected Pradhan, supported by an affidavit, for an enquiry being conducted in accordance with Section 95(1)(g) of the Panchayat Raj Act. The District Magistrate has not taken any action thereon. Hence this petition.
No useful purpose would be served in keeping the writ petition pending.
Let the District Magistrate, Hapur examine the complaint of the petitioner in accordance with law and appropriate action, as may be warranted under law, may be taken within four weeks from the date a certified copy of this order is filed before him, after affording opportunity of hearing to the Pradhan.
The writ petition is disposed of.
