By means of this application, the applicant has questioned the order of recovery warrant dated 06.12.2018 whereby Rs. 36,000/- is sought to be recovered from the applicant.
At the very outset, the applicant submits that the counsel for the applicant is ready to deposit entire amount in three equal installments, one falling on 06.02.2019, the second on 06.03.2019 and the third one on 06.04.2019 and shall continue to deposit monthly maintenance amount as directed by the Court below.
In view of the above, undertaking being so given by the applicant through his counsel before the Court, the order dated 06.12.2018 is put in abeyance.
However, it is further directed that in the event of default of any of the directions contained hereinabove, this protection shall cease to operate and the Court below shall adjudicate the proceedings in accordance with law for the recovery of the amount of maintenance and no further petition shall be entertained in this regard.
