1. Heard Sri D.S. Pandey, learned counsel for applicant and learned A.G.A. for State.
2. This is a bail application moved by accused-applicant for enlarging him on bail in Case Crime No. 1676 of 2015, under Sections 498A, 304B IPC and 3/4 Dowry Prohibition Act, Police Station Kaptanganj, District Kushinagar.
3. Applicant is husband. Marriage was solemnized on 03.06.2015 and just after six months applicant's wife died due to burn injuries. It is submitted that when Informant and other family members of deceased came at the resident of applicant, body was lying inside room and door was locked from inside, which shows that there was no involvement of in-laws. However, it could not be explained as to when deceased sustained burn injuries why in-laws could not make attempt to save her by breaking the door and allowed her to die and even thereafter did not take any steps to bring her body outside but waited till deceased's family members come and lodged report. Post mortem report duly shows that death has caused due to anti-mortem burn injury. Looking to entire facts and circumstances, I do not find it a fit case for grant of bail.
4. Application is accordingly dismissed.
