Heard learned counsel for the petitioners; learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 04.02.2018 registered as Case Crime No.70 of 2018, under Sections 420, 467, 468, 471 IPC, P.S. Bisalpur, District Pilibhit.
The allegation in the first information report, which has been lodged by the Tehsildar, Bisalpur, is that the guarantee deed submitted carries his forged signature.
The first information report has been lodged by naming Smt. Nanhi Devi (guarantor).
On 07.01.2019, we had required the leaned A.G.A. to seek instructions as regards the status of the investigation as also whether any material has been collected against the petitioner or not.
Learned A.G.A. has pointed out, on the basis of the instructions, that the guarantee deed was not only executed by Smt. Nanhi Devi but also by Lalta Prasad (the petitioner) and the signature of the Tehsildar is stated to have been forged by the petitioner and therefore the petitioner is involved in the crime.
Be that as it may, looking to the nature of the allegations, without expressing any opinion on the merits or correctness of the allegation, we are of the view that since the first information report does disclose commission of cognizable offence, no case for interference is made out. The petition is dismissed.
