Heard Mrs. Vanashri Dubey, learned counsel for the petitioner and learned Standing Counsel for the State respondent.
The petitioner is before this Court with request to issue direction to the Sub Divisional Magistrate, Tehsil Soraon, District Allahabad to decide the application/Suit No.T20160203032211 under Section 76 (d) (d) of U.P. Revenue Code, 2006 (Lallu vs. State) within stipulated time and to implement the order of the Chief Revenue Officer, Allahabad dated 21.3.2016.
Learned counsel for the petitioner states that the aforesaid proceeding is pending since the year 2016 and since filing of the aforesaid application, there is no progress in the said proceeding. The request has been made for issuing direction to the respondent to decide the aforesaid said expeditiously.
Learned Standing Counsel fairly states that in case the aforesaid suit is still pending and has not been disposed of, the same will be considered and decided expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the sole respondent, Sub Divisional Magistrate Soraon, District Allahabad to decide the aforesaid suit as expeditiously as possible and preferably within a period of six months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost.
