Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the marriage of his sister's sons scheduled on 15th April, 2012 and 25th April, 2012.
Along with this application, brother of the applicant has also moved an application being Criminal Misc. Application No.4536 of 2012 on which, he is being enlarged on temporary bail from 14th April, 2012 to 20th April, 2012 with the further direction that he shall surrender to the jail authority on 21st April, 2012.
Considering the totality of the facts, it is ordered that the present applicant shall be enlarged on temporary bail from 23rd April, 2012 to 27th April, 2012 on personal bond of Rs.5,000/- with one surety of the like amount and with the further direction that applicant shall surrender to the jail authority on 28th April, 2012.
Application is allowed to the aforesaid extent. Rule made absolute.
It is also ordered that the present order shall be implemented only after the applicant of Criminal Misc. Application No.4536 of 2012 surrenders to the jail authority pursuant to the order passed by this Court.
Direct service is permitted.
