None is present for the appellant. Shri Pramod Kumar Singh, learned State Law Officer is present on behalf of the State.
Office report dated 06.08.2021 indicates that the sole appellant- Lalji has died. I have perused the report of learned Chief Judicial Magistrate-Allahabad dated 06.07.2021 which states that sole-appellant-Lalji has died. In this respect, learned C.J.M- Allahabad has recorded the statements of Serving Officer-S.I.- Santosh Kumar Yadav, Gram Pradhan-Lalita Devi, Gulab Chandra, brother of the deceased. He has also annexed alongwith the report, the Death Certificate dated 23.06.2021 issued by the Gram Pradhan-Lalita Devi and a photocopy of Death Certificate issued under the Registration of Births and Deaths Act-1969.
From the above, it is proved that the sole-appellant Lalji has died, therefore, the appeal against him stands abated.
The present criminal appeal is dismissed as abated.
The appellant was enlarged on bail vide order of this Court dated 23.11.2001, therefore, the bail bonds are cancelled and sureties are discharged.
