Heard learned counsel for the applicants; the learned A.G.A. for the State- opposite party no.1; and Sri A.R. Nadiwal for the complainant-opposite party no.2.
The instant application has been filed seeking quashing of the proceeding of Complaint Case No. 2603 of 2017, under Sections 498A, 323, 324 I.P.C. and section 3/4 D.P. Act pending in the Court of A.C.J.M.-IVth, Saharanpur.
A perusal of the record would reveal that there are specific allegations against the applicants of having assaulted and harassed the complainant in connection with demand of dowry. The learned Magistrate, after considering the complaint allegations as also the statements recorded under Sections 200 and 202 Cr.P.C., has proceeded to summon the applicants for the offences punishable under Sections 498-A, 323 and 324 and section 3/4 D.P. Act.
This Court does not find any legal error in the summoning order nor any ground is made out to quash the proceedings, particularly in view of the serious allegations made in the statement of the victim (Rachna), which is at page 22 of the paper book.
At this stage, learned counsel for the applicants submitted that the matter may be referred for mediation.
This court has been informed that in every district of the State, mediation centres have been established and therefore the applicants are at liberty to make such request before the Court where the matter is pending.
