Heard the learned counsel for the petitioner and learned standing counsel.
Notice need not be issued to the private respondents in view of the order proposed to be passed.
Petitioner by the instant writ petition seeks the following relief :
"a writ, order or direction in the nature of mandamus commanding and directing the respondent no. 2 to decide the Case No. T.B of 2010, under Section 9(a)(2) C.H. Act, (Rajaram vs. Chhotey Lal), pending before him, in a short period as fixed by this Hon'ble Court."
Learned standing counsel at the outset would submit that the second respondent-Consolidation Officer, Tehsil Badlapur, District Jaunpur, shall pass appropriate order expeditiously.
In regard thereto, writ petition, on consent, stands disposed of directing the second respondent- Consolidation Officer, Tehsil Badlapur, District Jaunpur, to consider and decide the claim of the petitioner by a reasoned and speaking order in accordance with law expeditiously, from the date of filing of certified copy of this order after hearing the private respondents.
It is made clear that the Court has not considered the claim and contention of the petitioner on merits.
