Heard learned counsel for the petitioner, learned A.G.A. for the respondent Nos. 1 to 3 and perused the record.
The instant petition seeks quashing of the impugned First Information Report dated 5.11.2017 registered as Case Crime No. 1250 of 2017, under Sections 419, 420, 467, 468, 471, 504, 506 and 34 I.P.C. at P.S. Dhoomanganj, District Allahabad.
The contention of the learned counsel for the petitioner is that although the accused has obtained a protection order from this Court but that protection order did not restrain the investigating agency from carrying out the investigation of the case moreover it was to operate till the submission of Police report under Section 173(2) Cr.P.C. It has been submitted that for the last two years no investigation has been conducted in Case Crime No. 1250 of 2017.
The learned A.G.A. shall seek instructions as to why the investigation of the case has not been conducted and if it has been conducted then the current status of the investigation shall be disclosed.
