Heard learned counsel for the applicant and learned A.G.A. For the State.
This criminal Misc. application has been filed by the applicant for quashing the entire proceedings of complaint case No. 5057 of 2017 (Smt. Supriya Devi Vs. Santosh Chaubey and others) under Sections 498A, 323, 504 and 506 I.P.C and ¾ D.P. Act, Police Station Kotwali, District Ballia and further to quash the entire consequential proceeding including the summoning order dated 25.09.2018 passed by the Chief Judicial Magistrate, Ballia summoning the present applicant under Sections 498A, 323, 504, 506 I.P.C. and ¾ D.P. Act, Police Station Kotwali, District Ballia.
It is submitted by the learned counsel for the applicant that no offence against him is made out and the summoning order has been passed in order to harass the applicant. He pointed out certain documents and statements in support of his contention.
Learned A.G.A has accepted notice on behalf of the opposite party no.1.
Issue notice to opposite party no.2 returnable within four weeks at the address given in the application.
Steps be taken within one week.
Opposite parties may file their counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Until further orders of this court, entire proceedings of the aforesaid case shall remain stayed against the applicant.
