Court No. - 41
Case :- CRIMINAL REVISION No. - 472 of 1997 Revisionist :- Lakhpat Ram Opposite Party :- State of U.P. and Another Counsel for Revisionist :- G.R.S. Pal Counsel for Opposite Party :- Govt. Advocate
Hon'ble Mrs. Sunita Agarwal,J.
Office report indicates that despite notice served on the revisionist, no one appears so far.
The present revision is directed against the order dated 17.1.1997 passed by the Family Court, Bareilly in a proceeding under Section 125 Cr.P.C. An amount of Rs. 400/- per month was accorded towards maintenance as the wife has no source of income.
For a period of more than 22 years, it appears that the revisionist has been paid only Rs. 300/- per month during the pendency of the present revision under the interim order dated 22.4.1997.
Be that as it may, there is no illegality much less material irregularity or procedural impropriety in the decision of the court below.
The revision is, accordingly, found devoid of merits and hence dismissed.
Certify the judgment to the Court below immediately.
