Heard Sri Ajay Dubey, learned counsel for the applicant and Sri G.P. Singh, learned AGA for the State.
The present 482 Cr.P.C. Application has been filed with the prayer to direct the court below to conclude the trial of cross case being S.T. No.158 of 2003 arising out of case crime no.25 of 2001 and S.T. No.439 of 2009, arising out of case crime no.25A of 2001, P.S. Malpura, district Agra together and judgment may be pronounced of both the cases on the same day by the same trial court.
Learned AGA pointed out that the prayer made in the present petition is misconceived and not maintainable to which learned counsel for the petitioner could not waive out the preliminary objection of the learned AGA.
Learned counsel for the applicant states that the present application be dismissed as not pressed with liberty to file the fresh 482 Cr.P.C. application.
The present 482 Cr.P.C. application is, accordingly, dismissed as not pressed with liberty to file the fresh 482 Cr.P.C. application with proper prayer.
