This application has been filed for quashing the order dated3.10.2017 passed by the Special Judge (SC/S.T. Act) Etah and order dated 16.7.2016 passed by Chief Judicial Magistrate, Etah as well as the entire proceedings of the criminal case no. 2389 of 2011 (State Vs.Lakhan Singh and others) under sections 419, 420, 461, 467, 471 I.P.C. P.s. Kotwali Nagar, District Etah pending in the court of Chief Judicial Magistrate, Etah arising out of case crime no. 277 of 2011.
The submission is that charges under sections 419 and 420 I.P.C. are not made out against the applicants. Applicants have already obtained bail and their discharge application has also been dismissed.
It is open for the applicants to move application under section 216 Cr.P.c. for amendment of the charges at the appropriate stage.
With the aforesaid observations the application is disposed of.
