Heard learned counsel for the petitioner; learned AGA for respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 2nd December, 2019 registered as Case Crime No.0661 of 2019, under Section 272 IPC and Section 60 of Excise Act at Police Station Munda Pandey, District Moradabad.
The allegation made in the impugned first information report is in respect of recovery of twelve bottles of illicit liquor with urea that was being used to lace the liquor. The petitioner is stated to have absconded from the spot.
As the allegations disclose commission of cognizable offences, the prayer of the petitioner to quash the first information report cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioner to apply for bail/anticipatory, as may be advised.
