Counter affidavit filed by Shri A.K. Yadav, learned counsel for the respondent and rejoinder affidavit filed by learned counsel for the petitioner are taken on record.
This writ petition has been filed by the petitioner praying for direction to the respondent no.2 to include the petitioner in counselling in Science and Maths subject under the reserved category of Scheduled Caste for the year 2013-14.
Learned counsel for the respondent nos. 2 and 3 has filed counter affidavit stating that last counselling took place between 18.1.2016 to 20.1.2016 but the petitioner did not participated in the same.
Learned counsel for the petitioner states that he was present in the counselling but he was not permitted to participate in the counselling on the ground that he was not a party in the writ nos. 22993 of 2015 and 25130 of 2015,whereby interim orders were passed permitting the petitioners to appear in counselling.
Learned counsel for the respondent nos. 2 and 3 has informed that in such matter where litigations are pending before the court if counselling will taken place petitioner shall be considered.
In view of the above statement of learned counsel for the respondent nos. 2 and 3 the writ petition is disposed of with the direction that if the respondents permit any candidate for counselling in future the case of the petitioner shall also be considered.
