Heard learned counsel for the petitioner and Sri Sanjay Kumar Singh, learned Additional Chief Standing Counsel for the State- respondent.
Petitioner is before this Court with a request commanding the second respondent to decide the representation/application dated 10.1.2019 regarding allotment of fair price shop of village Bhojipura, Block Dahgawan, Tehsil Sahaswan, District Budaun on compassionate ground as the father of the petitioner late Atar Singh, who died on 4.1.2019, was licensee of the fair price shop in question since long ago i.e. 30 years.
Sri Sanjay Kumar Singh, learned Additional Chief Standing Counsel has apprised to the Court that in compliance of the order dated 26.10.2018 passed in Sumpurnanand vs. State of UP and 2 others reported in 2018 (11) ADJ 550, the State Government has taken a policy decision on 15.2.2019 regarding allotment of fair price shop dealer for rural area as well as urban area under dying-in-harness quota.
In the facts and circumstances, no useful purpose would be served in keeping the writ petition pending consideration and with the consent of parties, the writ petition stands disposed of finally with a direction in case, in response of the Government order 15.2.2019, a fresh application alongwith the requisite fee and other relevant papers is being placed by the petitioner before the authority concerned within two weeks from today then the authority concerned would take a final call in the matter expeditiously.
