Madras High Court|05 January, 2017

JUDGMENT / ORDER

This writ petition has been filed to direct the respondents 2 to 4 to take immediate steps to include the petitioner or other member of the Founders Family to the Trust Board of the Trust and School Committee in the light of the order dated 08.02.2016 of the Honourable Supreme Court of India in SLP(C) No.13055/2012 in C.A.No.968/2016 and by considering the petitioner representation dated 22.09.2016.
2.According to the learned senior counsel appearing for the petitioner, in the earlier round of litigation, the Hon'ble Supreme Court by order dated 08.02.2016 in SLP No.13055 of 2012 in C.A.No.968 of 2016, has passed an order directing the concerned authority to hear the matter within a period of six months. Pursuant to the same, no order has been passed till date.
3.According to the learned senior counsel for the petitioner, till date no order has been passed in the petitioner's sister's application. Subsequently, the petitioner made a representation 22.09.2016 to consider his name also in the light of the supreme court order along with the application which was originally filed by his sister. Since the petitioner's sister application has not been considered till date, the petitioner's representation along with that application shall be heard together.
4.Learned counsel for the respondent would contend that the matter is pending from the year 2011, whereas the petitioner is not a party but taking into consideration the order of the Supreme Court and till date the matter is pending, the second respondent may be directed to consider the representation of the petitioner.
5.Heard both sides.
6.Taking into consideration of the supreme Court order and since the matter is pending from the year 2011 and till date no order has been passed, this court directs the second respondent to consider the petitioner's representation dated 22.09.2016 also, after giving notice to all parties including the petitioner's sister and the fifth respondent herein and pass appropriate orders in accordance with law within a period of six months.
