JUDGMENT / ORDER

It is seen that pursuant to the order passed by this Court in the writ petition, a communication was sent to the petitioner on 03.07.2015 indicating that he will be appointed on compassionate ground when his turn comes on seniority. Therefore, the learned Additional Government Pleader appearing for the respondent/contemnor submitted that there is no contempt, when this Court has only directed the authority to pass appropriate orders on the petitioner's request.
2. On the other hand, the learned counsel appearing for the petitioner submitted that the communication dated 03.07.2015 is not in accordance with the guidelines already issued by the Government. His contention is that the respondent should create supernumerary post, after obtaining permission from the Government even assuming that the vacancies are not available. I am of the view that all these contentions can be raised only in an appropriate proceedings challenging the order dated 03.07.2015. Therefore, I find that no contempt is made out in this case.
3. Accordingly, this Contempt Petition is closed, however, by granting liberty to challenge the said order, dated 03.07.2015, and seek appropriate relief. No costs.
