Heard learned counsel for the petitioner and learned A.G.A. for the State.
This writ petition has been filed against impugned externment order dated 03.04.2019.
The appeal is already pending before the Commissioner. The further contention is that even the Stay application is pending and has not yet been disposed of by the concerned commissioner.
The further contention is that the appeal has not yet been decided nor the stay application has been disposed of.
In view of the above facts and circumstances and looking to the nature of the controversy in issue, no purpose will be served in keeping the matter pending before this Court any further.
Accordingly the writ petition is disposed of with the following directions:-
In case, the appeal has not yet been disposed of along with the stay application, the same shall be heard and disposed of finally within a period of ten days from the date of production of certified copy of this order before the concerned court. Till the disposal of the appeal, no coercive action shall be taken against the petitioner. However, in case the appeal has already been decided along with the stay application, this order will not be given effect to.
Accordingly, the writ petition is disposed of.
