Heard Sri Raj Sing, learned counsel for the applicant, learned AGA and perused the record.
By means of the present application u/s 482 Cr.P.C. the applicant is assailing the validity and veracity of order dated 15.03.2018 passed by Ist Additional District and Sessions Judge, Court No. 1, Hathras in S.T. No. 13/2015 (State Vs. Shailendra Urf Sanjoo and other) Case Crime No. 1255/2017, u/s 354, 354-B, 452 and 376 (D) IPC and section 3/4 POCSO Act, P.S. Sadabad, District Hathras.
Submission made by the counsel for the applicant that the present application u/s 482 Cr.P.C is an off shoot of earlier application u/s 482 Cr.P.C. no. 12125 of 2017 in which the other coordinate bench of this Court vide order dated 10.10.2018 have stayed the proceeding. The apt remedy lie to get the interim order vacated was got clarified by the same Court and not moved by the present application.
Accordingly, the present application u/s 482 Cr.P.C. stands dismissed. Order Date :- 22.1.2019 Nisha
