This appeal is before us to question correctness of the judgment dated 19.06.2018 passed by learned Single Bench in Writ-C No. 21544 of 2018.
Learned Single Bench dismissed the petition for writ as that involves complicated disputed questions of facts which cannot be adjudicated in writ jurisdiction. Learned Single Bench kept the petitioner at liberty to approach appropriate Court for determination of the liability in question.
From perusal of the record, it also reveals that the petitioner has already approached the District Consumer Forum alleging deficiency in service against the respondent-Bank.
On going through the judgment impugned as well as record of the case, we are in absolute agreement with the findings arrived by learned Single Bench. The petition for writ involves several disputed questions of facts pertaining to the liability of the petitioner as well as alleged deficiency in service by the respondent-Bank.
In view of it, no interference with the judgment impugned is desirable. The appeal is dismissed.
The petitioner if prefers any application for early disposal of the application pending before the District Consumer Forum, District Siddharth Nagar, the same shall be considered sympathetically and in accordance with the law by it.
