Heard learned counsel for the petitioner, Mr Subham Agarwal, learned counsel for the respondents and perused the material on record.
The only prayer of the petitioner is that his appeal pending before the CIT (A) may be decided expeditiously in accordance with law, to which learned counsel for the department has no objection.
It is also not denied to the respondents that the appeal was heard in the year 2018.
Considering the facts and circumstances of the case, but without prejudice to the merits of the case, the writ Tax Petition is disposed off finally with direction to the respondent no.
1 to decide the appeal pending before it within a period of two months from today in accordance with law. For a period of two months no coercive action shall be taken against the petitioner.
