Heard learned advocate Mr. Niral R. Mehta appearing on behalf of applicant.

Learned advocate Mr. Mehta submitted that two to three occasions, efforts have been made by applicant to serve other side by direct service, but, not accepting it, therefore, he requests to issue fresh notice to opponent and permit the applicant to serve through R.P.A.D.

Considering his request, issue fresh notice to opponent returnable on 26 th February 2010.

Notice is to be served through course process as well as through R.P.A.D. to opponent.
