Supplementary affidavit filed today by learned counsel for the applicant is taken on record.
Heard learned counsel for the applicant, the learned A.G.A. and perused the record.
This bail application has been filed on behalf of the applicant involved in Case Crime No.65/2016 under sections 394, 302, 467, 468, 411, 120B and 25/27 Arms Act, PS. Pipiganj, District Gorakhpur.
It is urged that co-accused Ram Pravesh Yadav, Sikandar and Sunil Kumar Sahani have been enlarged on bail vide order dated 12.7.2017, 19.7.2016 and 21.8.2017 passed in Criminal Misc.Bail Application Nos.34250 of 2016, 22922 of 2016 and 34093 0f 2016; xerox copies have been placed on record; applicant is languishing in jail since 12.4.2016, having no criminal history as such, he is entitled to be released on bail.
The learned A.G.A. has opposed the prayer for bail submitting that applicant has criminal history of six cases, he is a gang leader; applicant has been named in the F.I.R. duly supported by the injured witness; recovery of looted articles was made from the applicant; it will not be in public interest in case, applicant is released on bail.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application.
The bail application is, accordingly, rejected.
The trial court is directed to expedite the trial and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial court concerned for immediate compliance.
