This petition has been filed to call for the records pertaining to the First Information Report in Crime No.184 of 2015 dated 10.04.2015 on the file of the Respondent No.1 and quash the same as illegal.
2. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) for the first respondent and perused the materials available on record.
3.The learned counsel for the petitioners contend that there is no prima facie case has been made out against the petitioners/A4 &A5 by the respondent/defacto complainant in the application itself. Hence, the 1st respondent police without any basis registered a case against the present petitioners/A4 &A5 under
Sections 147,148,294(B),353,324 and
506(ii) of IPC. Since, no material is available in the FIR against the present petitioners/A4 and A5, the FIR in Crime No.184 of 2015 may be quashed.
4.The learned Government Advocate(Crl. Side) on instructions, would submit that in this case the Court perused the entire records and after that the 1st respondent police registered FIR against the accused persons. Hence, there is no reason to quash the FIR and this petition may be dismissed.
5. Perusal of the records shows that there are some materials against the present petitioners, namely Maruthiah and Shobana/A4 and A5 in the FIR. Reading of FIR reveals that the Special Sub Inspector of Police, Vadipatti has recorded a statement from one Murugan, S/o. Perumal Maniam, aged 40 years reads as follows:

6. The above statement recorded by the Special Sub Inspector of Police in the hospital clearly reveals that there are materials available against the present petitioners. Hence the reasons stated by the petitioners that there is no material available against the present petitioners is not acceptable and the present petition deserves no merits and accordingly this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is also dismissed.
