Heard learned counsel for the applicant and the learned AGA.
The present application u/s 482 Cr.P.C. has been filed with a prayer to direct the learned Special Judge, SC/ST Act, Kaushambi to conclude the trial of S.T. No. 219 of 2019 (State Vs. Aziz Ahmad @ Ajju) arising out of Case Crime No. 283 of 2017, under Sections 376, 452, 506 IPC and Section 3(2) 5 of SC/ST Act, P.S. Pipri, District- Kaushambi expeditiously within stipulated period.
Learned counsel for the applicant has submitted that charges against the accused persons have been framed on 17.9.2018 and thereafter the trial has been lingering-on, on one pretext or the other.
Considering the facts and circumstances of the case, Special Judge, SC/ST Act, Kaushambi is expected to make all endeavours to conclude the trial expeditiously, preferably within a period of eight months from the date of filing of certified copy of this order after giving opportunity of hearing to both the parties without giving any unnecessary adjournments to either parties and there is no other legal impediment in deciding the aforesaid case.
With the aforesaid observations, the application u/s 482 Cr.P.C. is finally disposed of.
