JUDGMENT / ORDER

Court No. - 16
Case :- WRIT - A No. - 24992 of 2018 Petitioner :- Km. Anshsika Minor Respondent :- Union Bank Of India Through Its Deputy General Manager, Mumbai And 2 Others Counsel for Petitioner :- Raj Kumar Yadav,Sheo Ram Singh Counsel for Respondent :- Ashish Agrawal, Ashish Agrawal
Hon'ble Mrs. Sangeeta Chandra,J.
(Oral)
1. Heard learned counsel for petitioner and learned counsel appearing for respondents, Mr. Vivek Ratan Agrawal for Bank.
2. Grievance of petitioner is that her father late Deo Narayan son of late Ram Briksha was working as peon under respondent Bank and he was to retire at the age of 60 years on 24.03.2021. But, unfortunately, he died on 04.06.2013. His widow applied for Family Pension and was getting the same during her life time. But the widow, Smt. Sursati Devi also expired on 09.07.2017 leaving behind her the petitioner as the sole dependant of the deceased as well as Krishna Kumar and Pradeep Kumar who being minor sons of the deceased although they are brothers of petitioner, have not come forward before this Court, as has been pointed out by Shri Vivek Ratan Agrawal. The petitioner applied for grant of Family Pension to the respondent No. 1 on 21.08.2018 and again sent reminder.
3. Learned counsel for petitioner has pointed out that the letter sent by the Branch Manager, Union Bank of India, Khuthan, Jaunpur to the Regional Head, Regional Office, Jaunpur, Uttar Pradesh has been filed as Annexure - 6 to the writ petition. It is evident that although the matter was forwarded for appropriate action by the Branch Manager, Union Bank of India, Branch Khuthan, District Jaunpur to the Regional Manager, Union Bank of India, Regional Office at District Jaunpur, yet no decision has been taken till date.
4. Looking to the facts and circumstances of the case, this writ petition is disposed of without entering into the merits of controversy with a direction to the respondent bank to look into the grievance of the petitioner as raised by the petitioner and also to give an opportunity of hearing to the two minor brothers of the petitioner and take a reasoned decision thereafter within a period of two months from the date a certified copy of this order is produced before the authority concerned.
