Heard Sri Salilendu Kumar Upadhyay, learned counsel for the petitioner and learned standing counsel for the respondents.
The petitioner in the writ petition is seeking a directing to the respondents to consider his claim under the Mukhyamantri Kisan Evam Samuhik Beema Yojna.
It is stated that the son of the petitioner, Atendra Singh, was the head and sole earning member of the family of the petitioner who died due to snake bite. The scheme for payment of insurance has been filed as Annexure 1 to the writ petition. The case of the petitioner is that her claim is covered under paragraph 4 of the said scheme.
No useful purpose will be served by keeping the matter pending.
We, therefore, dispose of this writ petition with the direction that if the petitioner files a fresh representation before the District Magistrate, Mainpuri, respondent no.2 along with a certified copy of this order within 15 days from today in respect of the claim raised in this writ petition, the respondent no.2 shall consider and decide the claim of the petitioner in accordance with law expeditiously preferably within a further period of 3 months.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
